This Dynamic Domain Name Service (DDNS) service under the name of "NVRUSA.com service" is being made available by NVRUSA, . NVRUSA reserves the right to temporarily or permanently terminate the DDNS service for any reason at any time. The Customer should not rely on the availability of the DDNS service as a basis for purchasing any Neugent products, including without limitation the NVRUSA DVR manufactured by NVRUSA, Inc. 1. ACCEPTANCE OF TERMS NVRUSA . provides the NVRUSA DVR Dynamic DNS Service ("the Service") subject to the terms and conditions set forth in these Terms of Service. By completing the registration process and clicking the "I agree" button, the Customer agrees to be bound by all of the terms and conditions of the Terms of Service. 2. PRIVACY POLICY See the Privacy Policy at NVRUSA website for information on NVRUSA policies regarding user information. 3. PERMITTED USERS USE OF THE SERVICE IS LIMITED TO USERS OF THE NVRUSA DVR PRODUCT(S) MANUFACTURED BY NVRUSA ("PERMITTED USER(S)"). The Customer may use the Service only for personal, non-commercial purposes. The Customer acknowledges that he/she is of legal age or that he/she has obtained the permission of his/her parent, legal guardian or supervising adult, to use the Service. 4. REGISTRATION In order to use the Service, the Customer is required to register his/her profile information (including username, e-mail address and location) ("Account"). When registering an Account, the Customer must provide current, accurate, and complete information as prompted by the Service's registration form. As part of the registration process, the Customer will be asked to choose username and password. The Customer’s username and password will serve as the Customer’s "key" to the Service and therefore should be treated confidentially at all times. NVRUSA will not be responsible for any claim, loss, or damage arising from (i) the Customer’s failure to safeguard his/her password or other Account information or (ii) use of the Service under Your Account or password. 5. LIMITED USE OF SERVICE The Customer may use the Service only for personal, non-commercial purposes in connection with the Customer use of the NVRUSA DVR Product(s) manufactured by NVRUSA. NVRUSA reserves the right to, at its sole discretion, immediately terminate the Service without notice if the Customer: (1) fails to conform with the terms and conditions of the Terms of Service (2) intentionally or unintentionally violate any applicable laws or regulations; (3) conduct is harmful to NVRUSA business; (4) fails to conform with other policies or guidelines that NVRUSA has posted on NVRUSA Service; and (5) engage in acts that disturb or may disturb the Service operation NVRUSA reserves the right to remove the Customer’s account of the Service without any prior notice and without any liability if the Customer use the service beyond the Limited Service, breach any conditions of these Terms of Use. 6. INDEMNIFICATION The Customer agrees to indemnify, defend and hold harmless NVRUSA ., its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Service from and against all disputes, losses, claims, damages, liability, cost and expenses, including reasonable attorney fees and court costs, related to the Customer’s breach of the Terms of Service or to any information, software or other content placed on the Service by the Customer. 7. DISCLAIMER OF WARRANTIES THE CUSTOMER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT CUSTOMER’S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITH NO WARRANTY. NVRUSA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NVRUSA MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR FREE OF ANY VIRUSES NOR DOES NVRUSA MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. THE CUSTOMER UNDERSTANDS AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT THE CUSTOMER’S OWN DISCRETION AND RISK. 8. LIMITATION OF LIABILITY NVRUSA SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO GAIN ACCESS TO OR USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY. THE CUSTOMER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE SERVICE. THE CUSTOMER AGREES THAT NVRUSA WILL NOT BE LIABLE FOR ANY LOSS OF OR USE OF THE CUSTOMER'S DNS NAME, OR FOR INTERRUPTION OF BUSINESS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE. 9. INTELLECTUAL PROPERTY RIGHTS All rights, titles and interests in and to the Service and NVRUSA trademarks shall at all time remain with NVRUSA. 10. CHANGES AND MODIFICATIONS NVRUSA reserves the right, in its sole discretion, to modify, suspend, discontinue, and/or terminate the Service with or without notice to the Customer. NVRUSA reserves the right to at any time and from time to time, at its sole discretion, change and modify any terms and conditions contained in the Terms of Service as well as change or modify any addendum, policy or guideline incorporated by reference.
